  • Client and lead management
  • Message template creation and management
  • AI-powered conversation and engagement tools
  • Analytics and reporting features

3. User Accounts

To use the Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate, current, and complete
  • Maintain the security of your password and identification
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Send spam, unsolicited messages, or engage in any form of harassment
  • Transmit any viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service for any illegal or unauthorized purpose
  • Interfere with or disrupt the Service or servers connected to the Service
  • Collect or harvest information about other users without their consent

5. WhatsApp Business Platform Integration

When using WhatsApp messaging features, you agree to:

  • Comply with Meta's WhatsApp Business Platform Terms of Service
  • Obtain proper consent from recipients before sending messages
  • Only send messages to recipients who have opted in to receive communications
  • Respect WhatsApp's messaging policies and guidelines
  • Maintain the security of your WhatsApp Business Account credentials

6. SMS and Communication Services

When using SMS or other communication features, you agree to:

  • Comply with all applicable telecommunications regulations
  • Obtain proper consent from recipients
  • Include opt-out mechanisms where required by law
  • Not send messages to numbers on do-not-call registries

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Max Engage AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create or upload to the Service. By using the Service, you grant Max Engage AI a license to use, store, and process your content solely for the purpose of providing the Service.

8. User Content and Data

You are solely responsible for:

  • The content you create, upload, or transmit through the Service
  • Ensuring you have the right to use any content you upload
  • Complying with data protection laws when handling client data
  • Obtaining necessary consents for data processing

9. Payment Terms

If the Service includes paid features or subscriptions:

  • Fees are charged in advance on a recurring basis
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to change our pricing with 30 days' notice
  • Failure to pay may result in suspension or termination of your account

10. Service Availability

We strive to provide continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Max Engage AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • We are not responsible for any loss of data, profits, or business opportunities

12. Indemnification

You agree to indemnify and hold harmless Max Engage AI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us or using account deletion features if available.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law
